GENERAL TERMS AND CONDITIONS OF EBL FRANCE SAS
These Terms and Conditions (hereinafter “Terms”) apply to any order confirmed by a person, as a consumer with the company EBL France, directly on their website at the following address: https://gboost.bike, either by email or by phone.
The validation of an order implies the acknowledgment and membership of these Terms.
Orders validated on our online store, do not require a handwritten signature.
No general or specific terms from the buyer may, without expressed written acceptance of the EBL France SAS, avail them.
The Terms of SAS France EBL are available on the website (https://gboost.bike).
SAS EBL France reserves the right to change its terms and conditions at any time. It is your responsibility to consult and formally accept them before ordering. The new Terms will apply once they have been notified to Client, including simple insertion on the website of SAS France EBL (https://gboost.bike).
Our sales are exclusively governed by French law, to the exclusion of any other legal system.
· 2.1 Identification and Product Compliance
SAS France EBL presents on its website products with the necessary features to allow compliance with Article L 111-1 of the Consumer Code, which provides the opportunity for the buyer to know, before ordering, the characteristics essential of the products they wish to purchase. The photographs, text, graphics, data sheets are mostly derived from documentation developed by the manufacturers or EBL France. Only descriptive text forms have contractual value.

Prior to ordering, the buyer declares perfectly knowing the characteristics of the product. An order is considered “confirmed” once the EBL SAS France confirmed the receipt:

Each order is considered firm from the buyer therefore unchangeable.
EBL France reserves the right not to accept your order for any legitimate reasons, including those in the event that:

– One of your previous orders was not paid in full when due;
– A dispute over the payment of a previous order is being processed;
– More and consistent elements would pose a suspicion of fraud on your order.
The buyer must verify the completeness and compliance of the information we provide when ordering, especially regarding the name and delivery address. We could not be held responsible for any data entry errors and consequences (delay or error in delivery, for example). In this context, the costs incurred for the return of the order would be the responsibility of the customer.

Prices are listed on our website https://gboost.bike in € euro and all taxes (TTC) taking into account the VAT applicable on the date of the order. Any rate change will be reflected in the price of goods or services.
Due to constant changes in commodity prices, taxes and transportation rates, our rates are subject to change without notice.
Prices of goods and services indicated on the products of the website are excluded of delivery charges.
Bank charges, VAT and customs charges are to be paid for by the customer.
The prices applied to your order are the prices on our website the day of the purchase of your order.
Any order, whatever its provenance, is billed and payable in € euro only.
Payment is made under the conditions mentioned in the quotation and / or invoice.
Payment can be made by transfer or by PayPal or credit card via a secure PayPal site.
Full payment of the order is mandatory.
6. RETENTION OF TITLE
SAS EBL France retains ownership of goods until full payment including appropriate interest and late penalties (laws of May 12th 1980 and January 25th 1985).
The buyer shall ensure that the identification of goods is always possible. SAS EBL France reserves the right to take back the goods under retention of title clauses in the case of buyer’s financial difficulties as well as to charge restoration or product handling. Its rights also extend to claiming both the commodities and their prices if they were resold.

EBL France offers delivered directly to your home.
The conditions of deliveries, including costs and time are based on the mode of delivery.
The total amount of your shipping costs is indicated when you placed your order.
Generally products in stock will be sent within two business days and arrive usually within seven days in the countries of the European community. For other countries, we will use a fast carrier like DHL.
If your order contains several products with different delivery times, the delivery time of your order will be the longest one.
When you receive your package, we invite you to check its status before accepting the delivery.
If the package was damaged during transportation and that it was not specified to the carrier upon receipt, we cannot operate insurance. In this case, the EBL France SAS does not support the damage during transportation.
If you or your attorney, decide to accept a damaged package, you have to be careful: Register the details and have the carrier sign the form.
If you entrust the receipt of the product to a third party (your building concierge, hostess of the workplace for instance) they receive the package on your behalf and on your account.
For orders to another country than France, VAT, customs duties or other local taxes that may be required are the sole responsibility of the customer and under his full responsibility in terms of returns and payments to the competent authorities.
The professional customer is obliged to check the conformity of the goods delivered before signing the carrier’s delivery. If the client detects an anomaly concerning the delivery (damage, missing product, damaged package, broken product), he must refuse the package or make a reservation on the delivery.
8. RIGHT OF WITHDRAWAL
In accordance with Articles L. 121-21 and following of the Consumer Code, you have a period of fourteen days calendar from the receipt of the final product of your order to exercise your right of withdrawal without having to justify reasons or to pay penalties.
You must take your bear the direct cost of returning the product(s). You will be responsible for the impairment of the value of the product(s) resulting from manipulations (other than those necessary to establish the nature, characteristics and functioning of the product(s))
The transportation of the returned products is your responsibility; any damage to the products on this occasion is likely to obstruct the exercise of your right of withdrawal.
You must inform the EBL France SAS of your decision to withdraw by sending it before the deadline provided in Article L. 121-21, the withdrawal form mentioned in 2 ° of I of Article L. 121 -17 or any other statement, unequivocal, expressing your desire to go back. Do not forget to mention your name, address and attach to your email a copy of your invoice.
You will then return the goods to the company EBL France, at the latest within fourteen days of the communication of its decision to withdraw in accordance with Article L. 121-21-2.
Only items returned in a condition for their release for sale by SAS France EBL (this assuming they are returned in their original packaging or in packaging to equal protection of said articles during their return transportation) will be accepted. Accordingly, Articles returned incomplete, damaged or soiled will not be accepted.
· 8.1 REFUNDS UNDER A RETURN
Following your request of a revocation, the EBL SAS France, in accordance with the law, conducts your refund within 14 days of the notification of your withdrawal request and receipt of the returned product. In the absence of receipts, EBL France SAS reserves the right to delay your refund until the day of receipt of your product.
However, given the technical nature of products sold, this period may be extended to 30 days, especially when the product needs a technical audit.
The consumer will then be refunded by check or bank transfer in his name or via his PayPal account.

· 9.1 LEGAL INFORMATION
It is recalled that the consumer under the legal guarantee of conformity:
– Has a period of two years from delivery of the product to act

– Is not required to provide proof of the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the property, except for used goods
The legal guarantee of conformity is applicable irrespectively of the commercial guarantee and can cover your property.

· 9.2 COMMERCIAL WARRANTY
Before delivery or shipping, the EBL France SAS controls the operation of the product and inform the customer of all the measures, in order to keep the product in good operating condition and conservation.
All components of our electrical kits are guaranteed 1 year.
The warranty does not support the hardware used in the context of the competition, damages wear, misuse, lack of maintenance or failure, products subjected to modification by the customer, products used on a vehicle other than a bicycle, motor winding showing signs of overheating, the spoiled threads, batteries autonomy loss.
The products are delivered in accordance with the French legislation and standards applicable in France and Europe. Responsibility for EBL France SAS cannot be held liable for non-compliance with the legislation of the country where the product is delivered (for example in case of prohibition or handling of a product). It is up to the buyer to check with local authorities the possibilities of import and use of the products or services you plan to order. Photos are for illustrative purposes. Please refer to the description of each product to know the precise characteristics; and in case of doubt or if you wish further information, please contact the SAS EBL France.
All our electrical kits (battery + motor + controller) are designed to be used for a purpose and a set of specific charges. It is the liability customer and user to comply with the instructions, conditions and limits of use described in the manual dedicated to the product and the product pages of the website. The non-compliance with this may cause damage, total destruction or explosion of products that can cause property damage and / or injury.
SAS EBL France cannot be held to any compensation or reimbursement or be held liable for damages of any kind, whether tangible and intangible, tangible or financial that may result:
– Misuse of the products;
– Failure to follow instructions contained in the instructions for use;
– Of operator error;

12. APPLICABLE LAW AND DISPUTES
These general conditions of sale are governed by French law.
In case of dispute, and failing agreements, the parties will seize the Tribunal de Commerce de Grenoble.
Calling the court by the customer cannot be done without the agreement of EBL France SAS unless the customer can prove his lack of legitimate interest in the mere appeal to the court.
If any provision of these Terms is invalid, the validity is preserved for all other clauses.
Only the terms and conditions of the available version of the terms at the time of the order are applicable in the context of a legal relationship between EBL France SAS and its customers.
The terms and conditions that differ will be rejected.

13. Recycling of Batteries or defective products
Electronic systems and batteries cannot be disposed into household waste. You can bring it to your waste collection center or in special collection points free of charge.
